Terms of Use

You are visiting a site (the “Site” ) which is either owned or operated by Jolt Online Gaming Ltd and we are pleased to give you access to the Site itself and related materials, including without limitation, user accounts, titles, computer code, themes, objects, characters, character names, stories, dialogue, catch phrases, locations, concepts, artwork, animations, sounds, musical compositions, audio-visual effects, methods of operation, moral rights, transcripts of chat rooms, character profile information, recordings of games played, and any related documentation, applets, client or server software (collectively, “Site”) free of charge. Your use of the Site is subject to the binding legal agreement set forth below (“Terms”).

We reserve the right, at any time and from time to time, temporarily or permanently, in whole or in part, to: (a) modify or discontinue all or any part of the Site, including, but not limited to (i) restricting the time all or any part of the Site is available, (ii) restricting the amount of use all or any part of the Site is permitted, and (iii) restricting or terminating any user’s right to use all or any part of the Site, with or without notice; (b) charge fees in connection with the use all or any part of the Site; (c) modify or waive any fees charged in connection with all or any part of the Site; or (d) offer opportunities to some or all users of all or any part of the Site. You agree that neither we nor any of our affiliates, shall be liable to you or to any third party for any modification, suspension or discontinuance of all or any part of the Site, in whole or in part, or of any service, content or feature offered through the Services.

You understand we may update these Terms from time to time without giving you any notice. Your continued use of all or any part of the Site following the posting of changes to these terms will mean you accept those changes. Unless we let you know posting of changes to these Terms or otherwise giving you notice, any new features or updated content or applications that we make available in connection with the Site will be subject to these Terms.

BY USING THE SITE, YOU AGREE TO EACH OF THE TERMS SET FORTH HEREIN. IF YOU DO NOT AGREE WITH ANY TERM OR CONDITION SET FORTH HEREIN, DO NOT USE THE SITE FOR ANY PURPOSE.

Binding Arbitration

These Terms are governed by, and will be interpreted in accordance with, the laws of Ireland, without regard to any choice of law provisions. You agree that, with the exception of injunctive relief sought by Jolt Online Gaming for any violation of Jolt Online Gaming’s proprietary or other rights, any and all disputes relating to these Terms, will be resolved through the courts of Ireland.

How You Can Use the Site

You may use the Site for your personal, non-commercial use. You may make a single, temporary copy of any applications that your device executes content your device displays when you use the Site, but only for your personal, non-commercial use, and not for further distribution or transfer to others. You may not-and agree not to-modify, reformat, copy, display, distribute, transmit, publish, license, create derivative works from, transfer or sell any information, applications, products or other materials obtained from The Site, except as set forth in these Terms. Additionally, you may not frame or mirror any part of the Site without our express prior written consent; forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Site; create a database by systematically downloading and storing content from the Site; Intentionally or unintentionally violate any applicable local, state, national or international law and any regulations having the force of law; use any robot, spider, site search/retrieval application or other manual or automatic device to retrieve, index, “scrape,” “data mine” or in any way gather information, content or other materials from the Site or reproduce or circumvent the navigational structure or presentation of the Site.

Accounts

In order to access some features of the Site, you will have to create an account. You agree not to use another’s account without permission. When creating your account, you agree to provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. Although Jolt Online Gaming will not be liable for your losses caused by any unauthorized use of your account, you may be liable for the losses of Jolt Online Gaming or others due to such unauthorized use.

Notwithstanding anything to the contrary herein, you acknowledge and agree that you shall have no ownership or other property interest in your account or any other information or attributes associated with your account, and you further acknowledge and agree that all rights in and to your account or any other information or attributes associated with your account are and shall forever be owned by and inure to the benefit of Jolt Online Gaming.

Jolt Online Gamings does not recognize the transfer of any accounts or any other information or attributes associated with any accounts. You may not purchase, sell, gift or trade any account or any other information or attributes associated with any accounts, or offer to purchase, sell, gift or trade any account or any other information or attributes associated with any accounts, and any such attempt shall be null and void. You agree that you have no right or title in or to any content that appears in the Site, including the virtual goods or currency appearing or originating in the Site and any other attributes associated with your account or stored in the Site. Jolt Online Gaming does not recognize any virtual property transfers executed outside of the Site or the purported sale, gift or trade in the “real world” of anything related to the Site. Accordingly, you may not sell items for “real” money or otherwise exchange items for value outside of the Site.

Content / Submissions to The Site

On some parts of our Site or otherwise in connection with your use of the Site, you may be allowed to post or link to content or applications or provide comments for others to see (such material is referred to herein as “Content”). If you post, link to or contribute Content, you guarantee, represent and warrant to us that:

  • You have legal rights to post, contribute or link to such Content and it will not violate any law or the rights of any person;
  • While you or the rightful owner of the Content retain all of ownership rights in the Content, you give us (and have the necessary rights to give us) the royalty-free, irrevocable, perpetual, worldwide right to allow other people to view the Content as described in these Terms; and to use, distribute, modify, display, publicly perform, and create derivative works from the Content, in any and all media, in any manner, in whole or in part, without any restriction or responsibilities to you, consistent with the purposes and function of the Site;
  • You are entirely responsible for all Content you upload, post, e-mail, transmit or otherwise make available in any way by or through the Site;
  • You have the written consent, release or permission of each and every identifiable individual person in the Content to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of the Content in the manner contemplated by the Site and these Terms; and
  • For all Content, including all information and materials of any kind, including graphics, sounds, text, or otherwise posted or provided by any user by or through the Site, you understand that we are not responsible for the truth, completeness, objectivity, or usefulness of such Content, nor do we endorse any Content; we do not verify the identity of people using the Site; and we do not screen, monitor, edit or review Content before it appears on the Site. We do have the right, in our sole discretion, to monitor or remove any Content at any time and without notice if we believe doing so will improve the Site. We can also suspend or terminate use of the Site by anyone who does not follow these Terms. Nevertheless, because we do not prescreen Content, you understand that by using the Site, you may be exposed to Content that is offensive or objectionable.
No License Granted

Except for allowing you to use the Site for your personal use as set forth in the paragraph above, when you use the Site you are not receiving a license or any other rights from us, including intellectual property or other proprietary rights of Jolt Online Gaming. YOU UNDERSTAND THAT YOU HAVE NO RIGHTS TO THE SITE OR ANY OTHER JOLT ONLINE GAMING PROPERTY EXCEPT AS INDICATED IN THIS AGREEMENT.

Copyright

The Site is owed by Jolt Online Gaming or its subsidiaries, partners or licensees and protected by applicable law, with all rights reserved. Jolt Online Gaming takes the protection of intellectual property rights, including copyrights, very seriously. Jolt Online Gaming will terminate your access to, or use of, all or any part of the Site, without notice to you, if you infringe or misappropriate the intellectual property rights, including copyrights, of others.

Trademarks

Jolt Online Gaming and the Site are trademarks of Jolt Online Gaming Ltd. Other trademarks are the property of their respective owners.

Contests and Sweepstakes

From time to time, the Site might host or facilitate contests. In such cases, the contest rules shall be prominently displayed, and you agree to read such rules, comply with them and only participate in any such contests under and pursuant to the terms thereof.

Protecting Children

The safety of children is very important to us. Jolt Online Gamings intends for the Site to be a general audience site, however some parts of the Site may contain mature or adult content intended for people who are at least 18 years old. If you view this adult content, we understand that you are telling us that you are at least 18 years old and that the material you are viewing is acceptable to you. Parental control protections (such as computer hardware, software or filtering the Site) are commercially available that may assist parents in limiting access to content that may be harmful to minors.

Third Party Sites

The Site may contain links to other sites, applications or content, which links may appear to embed the Sites, applications or content hosted or provided by third parties into the interface of the Site. Your use of such other sites, applications or content is subject to the terms of use, if any, governing the use of such sites, applications or content. Jolt Online Gaming is not able to control these third party sites, applications or content, and assumes no responsibility for their subject matter, privacy policies, or practices. If there is any conflict between the Terms set forth below and any terms or notices set forth with respect to any sites, applications or content provided by any third parties, then the terms of such third party sites, applications or content will control your use of such sites, applications or content. Please review the terms of use for each third party provider of sites, applications or content so that you understand all of the terms that will apply. By using the Site, you expressly relieve Jolt Online Gamingfrom any and all liability arising from your use of any third-party sites, applications or content.

Conduct of Registered Users and Visitors

We believe that all users and visitors benefit from basic rules regarding conduct while using the Site. Widespread use and enjoyment of the Site is jeopardized when a few individuals act irresponsibly. To help everyone have a positive experience, we ask, and you agree, to follow the following basic rules of conduct when using the Site:

  1. You will follow these Terms and all applicable laws;
  2. You will never give your password to anyone (no Jolt Online Gaming employee will ever ask for it) and you will not provide your billing or credit information directly to any person;
  3. You will not harass, threaten or abuse other people when using the Site in any manner;
  4. You will not make excessive challenges or invitations to other users;
  5. You will not interfere with others’ use of the Site or act in a way that negatively affects other users’ enjoyment of the Site;
  6. You will not cheat and you will not use “exploits” or “dummy accounts” in any way;
  7. You will not participate in any action that, in the sole and absolute opinion of Jolt Online Gaming, results or may result in any authorized user of the Site being scammed or defrauded out of any items that such user has purchased or earned in connection with such user’s use of the Site;
  8. You will not upload, post, e-mail or otherwise make available any Content that is obscene or may be hateful or offensive on racial, ethnic, sexual or any other grounds; is harmful, vulgar or distasteful; or is defamatory, libelous, or invades another person’s privacy or proprietary rights, including any patent, trademark, trade secret, or copyrights of any party;
  9. You will not use or exploit any errors in design, features which have not been documented, or “bugs” to gain access or items in any way that is not generally known and intentionally made available by Jolt Online Gaming, and you will promptly report to Jolt Online Gaming your discovery of any such errors, features or bugs.
  10. You will not attempt to harvest any screen names of e-mail addresses for any commercial use;
  11. You will not collect or store personal information about any other individual on the Site, or otherwise stalk, repeatedly contact or harass another user;
  12. You will not impersonate any other person or misrepresent a relationship with any person or entity, including misrepresenting a relationship with Jolt Online Gaming Ltd; similarly, you will not adopt a false identity if the purpose of doing so is to deceive or defraud another;
  13. You will not use the Site to harm minors in any way, or encourage interactions with minors of a sexual nature;
  14. You will not manipulate the Site so as to hide your identity or participation in the Site (by using another person’s identity, changing headers, or otherwise modifying any other possible identifier);
  15. You will not post any Content that contains any viruses, cancel bots, Trojan horses, harmful code, or other computer programs or code designed to interrupt the Site, users’ ability to enjoy the Site, or the proper functioning of any software, hardware or equipment or materials used in connection with the Site; and
  16. You will not send any bulk unsolicited advertising, promotional information, e-mail or other solicitation (including without limitation junk mail, “spam,” chain letters or pyramid schemes of any sort) to any person through the use of the Site.
  17. You will not use any automated programs or “scripts” to advance your character or characters, acquire goods, or otherwise accrue benefits in an automated fashion.
  18. You will adhere to and abide by any policies or rules posted by authorized moderators or Jolt Online Gaming representatives in the Forums.

If you violate any of the guidelines set forth above, or any other aspect of these Terms, we reserve the right to suspend or terminate your rights to use the Site without giving you any notice. In the event that your rights to use the Site are terminated, you will immediately lose access to any information that may be on the system. YOU UNDERSTAND THAT Jolt Online Gaming IS NOT RESPONSIBLE FOR YOUR INABILITY TO ACCESS ANY INFORMATION ON THE SITE FOR ANY REASON, WHETHER BECAUSE OF TERMINATION OF YOUR ACCOUNT; SOFTWARE, HARDWARE, OR INTERNET PROBLEMS OR ERRORS; OR ANY OTHER REASON.

Indemnity

YOU UNDERSTAND THAT YOU ARE PERSONALLY RESPONSIBLE FOR YOUR BEHAVIOR WHILE USING THE SITE AND FOR ALL CONTENT PROVIDED VIA YOUR ACCOUNT, AND AGREE TO INDEMNIFY AND HOLD Jolt Online Gaming AND ITS AFFILIATES AND THEIR OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS HARMLESS FROM AND AGAINST ANY LOSS, DAMAGE, LIABILITY, COST OR EXPENSE OF ANY KIND (INCLUDING LEGAL FEES) THAT WE MAY INCUR IN CONNECTION WITH A THIRD PARTY CLAIM OR OTHERWISE, IN RELATION TO YOUR USE OF THE SITE, THE CONTENT YOU CONTRIBUTE OR LINK TO, OR YOUR ACCESS TO THE SITE, OR YOUR VIOLATION OF EITHER THESE TERMS OR THE RIGHTS OF ANY THIRD PARTY.

YOU UNDERSTAND THAT YOUR USE OF THE SITE (INCLUDING ANY DOWNLOAD FROM THE SITE AND ANY LOSS OF DATA OR OTHER DAMAGE TO YOUR COMPUTER SYSTEM YOU EXPERIENCE FROM USING THE SITE) IS AT YOUR SOLE RISK. Access Restrictions; Termination

We can terminate your access to the Site at any time. We may also remove any Content that you post without cause and without notice to you.

We can also change these Terms at any time, and your continued use of The Site after any change we make will mean that you agreed with the changes. We will do our best to provide notice to you about any changes but this may not always be possible. IN THE EVENT THAT YOU DO NOT AGREE TO ANY CHANGE, PLEASE DO NOT ACCESS OR USE THE SITE IN ANY MANNER FOR ANY PURPOSE.

Entire Agreement

These Terms are the entire agreement between you and Jolt Online Gaming. They supersede any and all prior or contemporaneous agreements between you and Jolt Online Gaming relating to your use of The Site. If any part of these Terms is determined to be invalid or unenforceable, it will not impact any other provision of these Terms, all of which will remain in full force and effect.

Official Rules

“Gangsta Zombies Sweepstakes”

SPONSORED BY GAMESTOP, INC.

1.             NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

2. Entry Period: “Gangsta Zombies Sweepstakes” (“Sweepstakes”) commences at 12:00:00 AM ET on July 25, 2010 and ends at 11:59:59 PM ET on August 21, 2010 (“Sweepstakes Period”). All entries must be received or postmarked by 11:59:59 PM ET on August 21, 2010. All interpretations of these Official Rules and decisions made by Sponsor relating to the Sweepstakes are final.

3.             Eligibility: The Sweepstakes is open to legal residents of the 50 United States and District of Columbia. Entrants must be at least 18 years of age or older at time of entry. Employees of GameStop, Inc., (“GameStop” or “Sponsor”) and Jolt Online Gaming (“Jolt”) and their respective parent companies, affiliated companies, subsidiaries, partners, dealers, manufacturers, distributors, sponsors, advertising agencies, promotion and administration agencies and any entity which is involved in any aspect of the creation, production, operation, execution or fulfillment of Sweepstakes, and their respective agents, employees, officers, directors, successors and assigns, together with the Sponsors, (“Sweepstakes Entities”), and their immediate families (i.e., parents, spouse, siblings, children, grandparents, step parents, step children and step siblings, and their respective spouses, and those living in the same household, whether or not related) are not eligible to enter the Sweepstakes. By participating in this Sweepstakes, entrants: (a) agree to be bound by these Official Rules and by the interpretations of these Official Rules by Sponsor and by the decisions of Sponsor; (b) acknowledge compliance with these Official Rules; (c) agree to comply with any and all applicable federal, state and local laws, rules and regulations; and (d) agree to release and hold harmless Sweepstakes Entities from and against any and all claims, injury or damages arising out of or relating to participation in the Sweepstakes and/or the use, misuse or redemption of the Prize (hereinafter defined).

4.             To Enter: There are two (2) methods of entry. There is a limit of one (1) entry per entrant regardless of the method of entry. This entry can be obtained by using either one of the following two entry methods:

To Enter Online via Game Participation: Visit a GameStop retail store and get a Gangsta Zombies Promo Card (“Card”).  Then go to apps.facebook.com/gangstazombies, complete all required fields on the online entry form, enter the unique code (“Code”) found on the front of the Card and proceed to play the Gangsta Zombies online game. Upon reaching Level 5, the participant will automatically receive one (1) entry to the Sweepstakes.

To Enter By Mail: Print your first name and last name, address, phone number and email address on a 3” x 5” card, affix postage and mail to: Jolt Online Gaming, 625 Westport Parkway, Grapevine, Texas  76051. Sponsor and Jolt are not responsible for lost, late, damaged, misdirected or postage due mail entries. Mail entries must be postmarked by August 21, 2010 and received by August 27, 2010.

All information submitted by entrants is subject to and will be treated in a manner consistent with Sponsor’s Privacy Policy accessible at www.gamestop.com/gs/help/privacypolicy.aspx and Jolt’s Privacy Policy accessible at http://www.joltonline.com/privacy_policy.  By participating in the Sweepstakes, entrants hereby agree to Sponsor’s and Jolt’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s and Jolt’s Privacy Policy.

There is a limit of a total of one (1) entry per entrant, either one (1) online or one (1) mail-in entry. If it is suspected that an entrant uses multiple e-mail addresses to submit more than one entry, only the first online entry will count. In the event of a dispute over who submitted a winning online entry, the authorized subscriber of the e-mail account , used to participate in the Sweepstakes at the actual time of entry, will be deemed to be the entrant. The authorized account subscriber for online entries is defined as the natural person who is assigned an e-mail address by an Internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Proof to Sponsor’s satisfaction of being the authorized account subscriber may be requested by Sponsor.

All entries submitted in compliance with these Official Rules and not disqualified are considered “Eligible Entries”. All entries become the sole and exclusive property of Sponsor. Entries will not be returned and receipt of entries will not be acknowledged. The odds of winning the Sweepstakes depend on the number of Eligible Entries received during the Sweepstakes Period.

5.             Prize: The Winner (hereinafter defined) will receive one (1) GameStop Gift Card valued at $1,000 (“Prize”). The Prize is valid for a twelve month period from date of issue. Other conditions and restrictions may apply. The approximate retail value (“ARV”) of the Prize is $1,000. The ARV is subject to change based on current market conditions at time of Prize fulfillment.  Any difference between the ARV and the actual value, if any, will not be rewarded.

6.             Winner Selection and Notification: There will be one (1) winner selected in a random drawing from among all of the Eligible Entries on or about August 30, 2010. Sponsor will make up to three (3) attempts over the 72 hour period following winner selection to contact the potential winner via the telephone number(s) and/or e-mail address provided on his or her entry form. No messages will be left on answering machines or voicemail systems. If a potential winner cannot be reached directly during the 72 hour period in which he or she is called or e-mailed, the potential winner will be disqualified and an alternate winner may be selected, in Sponsor’s sole discretion, from among the remaining applicable Eligible Entries received if time permits.

7.              Winner Verification: The potential winner must prove eligibility, including, without limitation, proof of age, residence and identity, which may include submitting a copy of a driver’s license, passport or similar government issued identification, as well as proof that he or she is the authorized account subscriber of the e-mail address of the winning entry, within three (3) days of being notified as the potential winner. In the event of non-compliance by the potential winner such potential winner shall be disqualified and all privileges otherwise due as the winner shall be terminated and an alternative potential winner may, in Sponsor’s sole discretion, be chosen from among all of the remaining Eligible Entries received. To be eligible to be declared the winner and to receive the Prize, the potential winner must sign within five (5) days of receipt of such documents from Sponsor: (a) an Affidavit of Eligibility and Release releasing Sweepstakes Entities from any and all liability, loss, claims, demands, and causes of action for personal injuries or death and/or damage to personal or real property, theft, loss, or any other harm suffered directly or indirectly from potential winner’s participation in Sweepstakes, including, but not limited to, traveling to, preparing for and/or participating in any Prize related activity, or the acceptance, possession, or misuse of any Prize, to be eligible for the Prizes; and (b) except where prohibited by law, a publicity release granting Sweepstakes Entities the right to use potential winner’s name, picture and/or likeness, biographical information or voice for trade, advertising and publicity purposes, in any media now known or hereafter to be invented, throughout the world, in perpetuity, without additional compensation or consideration or notification. Entry into Sweepstakes constitutes agreement to sign such releases and documents, and when properly executed, potential winner will be determined to be the Sweepstakes winner (“Winner”). Sponsor expressly reserves the right to delay the announcement of the Winner for any reason Sponsor deems necessary.

Winner must also complete any additional legal documents provided by Sponsor with respect to the Prize and return them as instructed within the time frame specified or Winner may forfeit Prize at Sponsor’s sole discretion.

8.             Prize Terms: The dates for fulfillment of the Prize will be on or around August 30th, 2010, but subject to change in Sponsor’s sole discretion. If for any reason any Prize is unavailable, Sponsor reserves the right, but is not obligated, to cancel or modify the Sweepstakes in its sole discretion and award a substitute Prize, or portion of Prize, of comparable or greater value, as set forth in these Official Rules. No substitution, transfer, assignment or cash equivalent of the Prize, or any portion thereof, is permitted.  Sweepstakes Entities shall have no responsibility or obligation to a Winner or potential Winner who is unable or unavailable to, or who does not for any reason, accept or utilize the Prize. All costs and expenses not specifically listed above as part of the Prize including any equipment to be used in connection with the Prize are solely Winner’s responsibility. Prizes are provided “as is”. Entrants acknowledge that Sweepstakes Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Prize, including any express warranties provided by a Prize supplier that are sent along with the Prize. Arrangements for the fulfillment of the Prize will be made by Sponsor.

The value of the Prize will be taxable to Winner as income. An IRS Form 1099 will be issued in the name of Winner for the actual value of the Prize granted. All federal, state and local taxes, and any other costs and expenses associated with acceptance and/or use of Prize not specifically provided for in these Official Rules are solely the Winner’s responsibility.

9.             General Terms: Sweepstakes Entities are not responsible if the Sweepstakes cannot take place, or if any Prize cannot be awarded due to delays, interruptions or failures due to acts of God, war, natural disasters, weather, acts or threats of terrorism, strikes, lockouts, labor disputes, work stoppages, fire, acts of government, or other events outside of the reasonable control of Sweepstakes Entities. If, for any reason the Sweepstakes is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sweepstakes Entities, which, in Sponsor’s sole determination, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes or any part of the Sweepstakes. If the Sweepstakes is terminated prior to the expiration date stated herein, notice will be posted on apps.facebook.com/gangstazombies and the Prize may be awarded to a potential winner to be selected from among all Eligible Entries received up until and or after, if applicable, the time of modification, cancellation or termination or in a manner that is fair and equitable as determined by Sponsor. Sponsor reserves the right to modify and amend these Official Rules from time to time during the Sweepstakes for clarification purposes without materially affecting the terms and conditions of the Sweepstakes.

Entrants agree to indemnify and hold harmless Sweepstakes Entities from any and all liability arising out of or relating in any way to entrant’s participation in the Sweepstakes and to release all rights to bring any claim, action or proceeding against Sweepstakes Entities. Sweepstakes Entities assume no responsibility for and will disqualify entries that are: stolen, late, lost, illegible, incomplete, invalid, unintelligible, damaged, destroyed, delayed, misdirected, not received, postage due mail entries, that have incorrect or inaccurate entry information, whether caused by any of the equipment or programming associated with or utilized in the Sweepstakes, or by any human, mechanical or electronic error which may occur in the processing of the entries in the Sweepstakes, or other errors appearing within the Official Rules or in any Sweepstakes related advertisements. If due to a printing, production or other error, more prizes are claimed than are intended to be awarded, the intended Prize will be awarded in a random drawing from among all verified and validated prize claims received. In no event will more than the stated number of Prizes be awarded. Sweepstakes Entities assume no responsibility for any typographical or other error in the printing of the offer, administration of the Sweepstakes, errors in processing entries, identifying the Winner, in the announcement of the Prize and Winner, and the delivery of the Prizes, any problems or technical malfunction of any telephone network or lines, computer systems, online systems, servers or providers, computer equipment, software, failure of any e-mail or players on account of technical problems or traffic congestion on the Internet or on any web site, or any combination thereof, including, without limitation, any injury or damage to entrant’s or any other person’s computer system/software related to or resulting from participation or downloading any materials in the Sweepstakes. Use of any device to automate or subvert entry is prohibited. No software-generated, robotic, programmed, script, macro or other automated online entries are permitted and any entries received by such means will be void. Sponsor reserves the right in its sole discretion to disqualify any person they suspect or find: (i) to have used a software generated, robotic, programmed, script, macro or other automated online entry; (ii) to have tampered with the entry process or the operation of the Sweepstakes; (iii) to be acting in a disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person; (iv) to display behavior that will bring such Winner or Sweepstakes Entities into disgrace; (v) to have provided inaccurate information on any legal documents submitted in connection with the Sweepstakes; or (vi) to be acting in violation of these Official Rules.  ANY VIOLATION OF THESE OFFICIAL RULES BY THE WINNER WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS THE WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS THE WINNER WILL BE IMMEDIATELY TERMINATED.

ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVL LAW AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITED BY LAW. THE TEXAS COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE SWEEPSTAKES AND THE LAWS OF THE STATE OF TEXAS SHALL GOVERN THE SWEEPSTAKES. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THESE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THESE COURTS.

10.          Request for Names of Winner and Official Rules: All requests for a copy of the Official Rules and for the name of the Winner must be made by September 30, 2010.
